Q1: GTS申请工签是封闭工签还是开放工签?
GTS工签为封闭式工签(Closed Work Permit),仅限于特定雇主和职位。工人不能自由换工,如需换雇主须重新申请。
💼 高薪/低薪LMIA (High-Wage / Low-Wage LMIA):这是最常用的LMIA通道,适用于GTS清单以外的各类职业。根据薪资是否达到所在省/地区的中位数工资,分为高薪和低薪两个类别,各自有不同的雇主义务。 The most common LMIA pathway for positions outside the GTS list. Split by whether the offered wage meets or exceeds the provincial median wage.

⚠️ 2025年起限制收紧:低薪LMIA在餐饮服务和零售行业的某些地区(失业率≥6%)不予受理。低薪员工比例上限10%(10人以上企业)。 Since 2025, low-wage LMIAs for accommodation/food/retail are not processed in regions with unemployment ≥6%. Cap of 10% low-wage TFW workforce (employers with 10+ employees).

🏢 企业合法性证据不足 / Insufficient Business Legitimacy
2024–2025年ESDC大幅收紧对雇主业务合法性的审查,尤其是针对:小型独资企业、成立不足2年的新公司、外资控股企业(在加无独立业务活动)、经营与职位不匹配的企业。 ESDC significantly tightened business legitimacy standards since 2024. Sole proprietors, startups, foreign-controlled businesses, and companies with inconsistent business activity face higher rejection rates.
如提供薪资低于Job Bank该职业/地区的中位数工资,将直接导致LMIA被拒(视为"未满足劳动力市场因素")。薪资须在LMIA有效期内持续满足中位数要求,工人入职时须核查最新工资标准。 Offering below-prevailing wage automatically triggers a negative LMIA decision. Wage must meet the prevailing rate throughout employment — re-check Job Bank wage before the worker starts.
常见问题:①广告不足4周;②广告渠道少于3个;③广告未包含Job Bank;④广告内容与LMIA申请中的职位描述/薪资不一致;⑤广告在申请前已下线;⑥未保留申请人评估记录。 Common issues: under 4 weeks, fewer than 3 channels, no Job Bank ad, inconsistencies between ad and application, removed ads, missing applicant log.
内容模糊(如:"我们计划培训更多加拿大人")、缺乏可量化目标、复制通用模板而非针对企业实际情况定制,是高薪LMIA和GTS申请被拒的常见原因。续签时如无法证明计划执行进展,同样会被拒。 Vague, non-specific, or copied plans are commonly rejected. Renewal applications must show evidence of progress on previous commitments.
这是最严重的违规行为之一,会直接导致LMIA被拒并可能被列入TFWP禁止名单。LMIA申请费($1,000)以及任何代理服务费均不得直接或间接向外籍工人收取。 This is one of the most serious violations — results in automatic negative LMIA and possible TFWP ban. No fees (LMIA fee or consultant fees) may be passed to the TFW directly or indirectly.

Penalties up to $1M per violation, public listing, ban.
失业率≥6%的地区,住宿/餐饮/零售行业的低薪LMIA申请将不被受理。季度更新的限制地区名单可能随时变化。申请前务必核查。 In census metropolitan areas with ≥6% unemployment rate, low-wage LMIA applications for accommodation, food services, and retail are refused. List updated quarterly.
